Domestic and Sexual Violence in the Church: A Sisterhood Reality ...

?Reality Show is the new field for evangelism.? ? Brian S. Lewis

I watched one episode of the show and was really disappointed in the lack of spiritual guidance used to advise the public about important topics such as pornography, and pedophilia.

As an expert in child sexual abuse grooming??(pedophile behavior), and a minister, I want to help you understand how to resolve your personal crisis if this episode shared a problem that you are facing in your life.

During one scene when the ladies were in ?the Queen Maker?s? shop, who is Domonique Scott a character on the show, Tara brought up a phone call she received randomly from a friend whose husband is watching pornography.

What was the pastors response you ask? Tara told her friend to withhold sex from her husband in an effort to punish him stating that it would make him realize that he wanted to save his marriage.

Not only was this comment unscriptural because there is nothing in the word of God that tells a wife or husband to withhold sex, especially not in punishment (except for a mutually agreeable time like fasting)?but it is a form of domestic violence.

?My suggestion is that in terms of our love-making ? in terms of that, that that?s shut down. Make him realize he could lose his family and his marriage.? ? Tara Lewis, The Sisterhood.

In addition to Tara?s advice for the friend, she also said in her documentary-style interview that ?80% of all pedophiles have watched pornography at some point.?

What I find more alarming than realizing that this is the kind of individual marriage counseling that Tara would give to her church members if she had one, is that her purpose for bringing up this situation was to ask if that was the kind of thing that should be talked about on her talk show ?Phenomenal Life Today?.

After seeing that one episode, and listening to the above interview where Brian emphatically denies that they have done anything unrighteous on the show, and openly discredits the other cast members (which may be considered unrighteous to some) I decided to see if what he said was true.

Perhaps It wasn?t them, it was everyone else who were at fault. So, I watched other episodes and became grieved by more by this couple. If you keep reading, I?ll tell you the evangelism opportunity that I believe Tara missed out on, early in the show with another cast member.

Brian who is Tara?s husband on the Sisterhood is obsessed with us falling in love with them and seeing the ?truth? but I have to be honest, it was hard to do so. I wrote so many quotes down from his interview, that I decided not to write the article at all for a few days.

I found his interview to be redundant, manipulative, condescending, long-winded and possessing a superior-complex. While I wanted to believe him, it was difficult to move past some of the confusing rants. Honestly, I believe that less would have been more. After watching the audible interview (that I?ve provided for you to listen to here), I questioned whether this was a marketing ploy to engage interest in potential viewers.

Spiritual Parenting

I am also very concerned about their obsession with us understanding that their son is going to be the first black and jewish president of the United States of America in 2036. I almost stopped watching the show because I lost count on how many times they said black and jew(ish) out of their mouths.

He seems like a typical child, but they call him regal. Both parents keep talking about what they want the child to be like, instead of learning about his true gifts, and his passions.

This is not spiritual parenting, which is a topic that I cover in my new book, Sexual Discipleship: The Strategic Plan to Legalize Sex with Children using the Ten Ways to Safeguard your Child from Sexual Abuse with acronym S.A.F.E.G.U.A.R.D.S.? The first ?S? in safeguards, stands for spiritual parenting.

I believe that as spiritually intuned parents we can hear a word from God about our children, and we use this information as a guide in parenting them, not to constantly tell them who they are (in the natural). God gave us free will, and this child will need to choose to be the next president if she did in fact hear this from God about her son when he was six weeks old.

The parents job is to plant the seed and till the ground giving him what is necessary to become the president in 2036 but not force, coerce, manipulate, and exert power and control over the child in order to make Jesus? plans come to pass. This is too forms of domestic violence shown within the same couple, toward their child. Jesus does not exert power and control. There is only one spiritual force concerned with exerting power and control, and it is not God.

Evangelism

Brian and Tara seem possessed with presenting themselves as holy and the other cast member was correct in stating that scriptures are not always needed for evangelism.

Jesus presented himself, and we are to present him through us. This does not mean that we don?t use scriptures at all, it just means that we do not live in a judgmental, unapproachable place that can not be penetrated or relatable to those that we claim we are called to minister to.

Your evangelism is a deep ministry to operate in, understanding that your influence can mean life or death. For any person regardless of their faith or beliefs, we need to understand that the foundation of a person is their understanding of their faith and beliefs. The approach in which Brian and Tara communicate is unlikable and may be ineffective with the audience that they intend to evangelize to.

My intention is not to insult them. In fact, I learned different ways to evangelize because I am not an evangelist and feel uncomfortable walking up to random people on the streets but my friend, like Tara (but not) is an evangelist.

My friend who has a name oddly close to Tara turned a simple conversation of romantic interest into a ministry session in front of the grocery store! She went back to my car to get them tracks which are a ministry tool to talk about salvation.

If someone feels that you are not genuine, that you are judgmental, that you think you?re better, or that you lack compassion, your evangelism makes others lose interest in God. People associate how authentic God is, by how authentic you are.

Domonique is a pastor?s wife who appears on the show. She presents herself as incredibly unhappy on the show in her marriage in repeated statements. She also is saddened that they have not overcome financial crisis?, and admits that they were the main contributors in their church, and were also are not good with handling money.

When she made the above statement however I did not know if anyone would realize how honest, empowering and mature of her to acknowledge that she is emotionally unstable because of the abuse that she endured ? including during her days of being a prostitute. I agree with her, that she is not ready to take on the role of a pastor until she is healed.

What I found challenging about the Brian and Tara Lewis belief that they are on a different, more mature spiritual level than the other cast members, were their inability to make a connection with Domonique that would encourage her healing.

I thought it profoundly mature for Domonique to admit that she did not know if she was ready to become a pastor of another church until she dealt with the feelings that she had inside as a result of the domestic and sexual violence that she suffered throughout her life. And equally mature for her to be honest to her husband, and he suggest counseling that she (as we saw on the show) accepted.

What I believe was missed as an opportunity to evangelize by Tara was that at the controversial table argument that questioned Tara?s approach to evangelism, Domonique was really calling out the cast to be her friends who would be honest with her, cultivate a friendship with her, and stand by her as she healed.

Domestic Sexual Violence

For many years pastors have promoted domestic and sexual violence to their church members without realizing that they have done so. People are destroyed for a lack of knowledge and this lack I believe holds some responsibility for the divorce rates, and poor relationships in church.

The holy spirit should be the advantage of seeking counseling from a christian counselor but when pastors really do not know how to help a member of their congregation, they need to ask God who should.

When I needed healing in my family, my pastor made it clear that he thought the help we needed was outside of his scope. He is anointed but the type of healing that we needed which came from years of domestic and sexual violence within my immediate family had to come from someone who he trusted would maintain integrity of the message of Jesus. ? It has to come from someone who could help us to overcome the pains of the past to move toward healthy relationships.?I talk about my personal experience with domestic and sexual violence in my memoir, Identity Crisis, Identity Christ Is: A Journey to Love.?

The reason that Tara?s advice was so alarming was because of the following:

  • Withholding sex as punishment is a form of Domestic Sexual Violence.
  • Withholding sex as punishment is unbiblical.
  • Her statements made it seem like the husband could be a pedophile.

Sexual abuse or violence exists in marriage. If you are married and you say that you do not want to have sex, and your spouse forces you ? that is called rape, period. On the other hand, if you are married and your spouse says that they are withholding sex from you as a punishment, this too is a form of sexual violence.

This does not mean that a spouse can not take a night off but healthy relationships have communication and work together to make sure the needs of each other are met in their sexual relationship. Also, as an aside, if a spouse is cheating, this is a form or sexual abuse in marriage, and your spouse (who was cheated on) may not feel comfortable having sex with you ? but making a personal choice and withholding are different. Domestic abuse is about power and control. Many church leaders, and their members are unaware of what the bible or the world identifies as abuse. Domestic Sexual Violence is often coupled with other forms of abuse like emotional, or psychological and physical abuse.

The reason that withholding sex is a form of abuse is due to the power and control nature and intention behind the act. It is a form or coercion, manipulation, inappropriate restrictions and other adjectives that are used to describe how people abuse, on the power and control wheel.

From a biblical perspective, power and control are exerted through tactics used by the enemy to steal, kill and destroy. When you learn this and understand that God is never interested in exerting power and control over you, but presenting free will because he wants to be your choice, you will come to identify love and the enemy more easily.

Tara?s second statement about the pedophiles was pretty accurate however, her positioning of the statement needed further information. Not everyone who watches pornography is a pedophile but 80% of pedophiles do watch ? and learn forms of sexual abuse from pornography. She implied that this woman could be at-risk to being married to a pedophile however this is not a sign that everyone can use to determine if one is a pedophile.

In addition, she did not indicate that the woman?s husband was watching child pornography, so I was not sure why she gave such an uneducated assumption.

The Sisterhood

Each person did this for a purpose and I?m sure for each one of us if we were where we wanted to be in our ministerial station, we would not have chosen to do this show. I?m just gonna be for real like, u ? if we all had the churches we wanted ? you know, if I were T.D. Jakes, we probably wouldn?t do it because we are at a certain [financial] level.

So everybody on this show is hungry for something, whether it was recognition, whether it was fame, whether it was money, whether it was a second chance ? it could be anything. Not all of it is a sin, we all have different motivations. For us, we had a motivation to have a second chance, as well as to advance the kingdom of God. Brian S. Lewis, the Sisterhood

In closing, I thought that the idea of the show was horrible because any person who has clients, members etc whether in the healthcare or religious community has a responsibility to maintain total confidentiality, and I was unsure how this could be achieved with a television show. Since it has aired, I realize that these women (most of them) do not have churches or congregations.

Incidentally, I don?t know how you start a ?televangelist? ministry with no church or members but that is not my vision ? it is Tara?s. I don?t have to understand it. In response to Brian?s above comment, our motivation as ministers should be to hear and do what God has called us to do. And if God is big enough to give us the vision, make it plain so we can run with it, he can also tell us where to run to, in order to accomplish it.

I was doing research for this article and realized that I have more followers on all of my social networks than these ladies. We see people on television and assume this makes them relevant or famous. It seems that the church has indeed spoken because the show may not have been cancelled before the series started but it is failing to have viewership and will unlikely withstand the unspoken boycott to cancel this show.

(AP) ? A new generation of more versatile BlackBerry smartphones is finally about to hit the market after excruciating delays allowed mobile devices made by Apple, Samsung and others to build commanding leads in a market that is redefining society.

BlackBerry maker Research in Motion Ltd. formally unveiled its long-awaited line-up of revamped smartphones and software Wednesday at simultaneous events held in New York, Toronto, London, Paris, Dubai, Johannesburg, Jakarta and Delhi.

In a move underscoring the stakes riding on its make-or-break product line-up, the Canadian company used the occasion to announce it is changing its name to BlackBerry ? a pioneering brand that has lost its cachet since Apple's 2007 release of the iPhone reset expectations for what a smartphone should do.

The first devices in the new crop of BlackBerrys will be called the Q10, which will feature a physical keyboard like previous versions of the phone, and the Z10 will have only touch-screen keyboard, like Apple's trend-setting iPhone and other handsets running on Google's Android software, including Samsung's popular Galaxy. They will run on a redesigned operating system called BlackBerry 10, which the company began working on after buying QNX Software Systems in 2010.

The new software and BlackBerrys were supposed to be released a year ago, only to be delayed while Apple and Android device makers won more zealous converts to their products. In the meantime, Microsoft Corp. also rolled out a new Windows operating system for smartphones giving RIM another technology powerhouse to battle. The delays helped wipe out $70 billion in shareholder wealth and 5,000 jobs.

"It is the most challenging year of my career," said RIM CEO Thorsten Heins, whose anniversary leading the company occurred last week. "It is also the most exhilarating and exciting one."

The wait for U.S. smartphone users interested in buying the new BlackBerry line isn't over. The Z10 won't be released in the U.S. until March and the Q10 might not arrive in the country until April, Heins said, to give wireless carriers more time to test the product. The estimated U.S. prices for the phones weren't announced either.

The Z10, which BlackBerry will call the "Zed-10" outside the U.S., will go on sale Thursday in United Kingdom Thursday. The same model will be released in Canada on Feb. 5 and will cost about $150 there with a three-year contract.

BGC Financial analyst Colin Gills said the new phones' tardy arrival to the U.S. threatens to cause even more BlackBerry users to defect to the iPhone or an Android device.

Wednesday's event didn't go over well on Wall Street. RIM's stock fell $1.18, or 7.5 percent, to $14.48 in afternoon trading.

Repeated delays have turned the once-iconic BlackBerry into an afterthought in the shadow of the iPhone and Android devices. That has led some analysts to question whether the company that helped create the smartphone market will survive, especially as its losses have mounted in the past year.

Yet there was renewed optimism heading into Wednesday's event. Previews of the BlackBerry 10 software have gotten favorable reviews on blogs. Financial analysts are starting to see some room for a comeback. RIM's stock has more than doubled from its nine-year low in September, though it's still nearly 90 percent below its 2008 peak of $147.

RIM redesigned the system to embrace the multimedia, apps and touch-screen experience prevalent today. The company is promising speedier devices, a superb typing experience and the ability to keep work and personal identities separate on the same phone.

Most analysts consider BlackBerry 10's success to be crucial for the company's long-term viability. Doubts remain about the ability of BlackBerry 10 to rescue RIM.

"We'll see if they can reclaim their glory. My sense is that it will be a phone that everyone says good things about but not as many people buy," Gillis said. He thinks the company will need to sell at least 5 million BlackBerrys each quarter to remain viable.

Jefferies analyst Peter Misek called it a "great device" and said RIM does have some momentum just months after the Canadian company was written off for dead.

"Six months ago we talked to developers and carriers, and everybody was just basically saying 'We're just waiting for this to go bust,'" Misek said. "It was bad."

The BlackBerry has been the dominant smartphone for on-the-go business people and crossed over to consumers. But when the iPhone came out, it proved phones can do much more than email and phone calls. Suddenly, the BlackBerry looked ancient. In the U.S., according to research firm IDC, shipments of BlackBerry phones plummeted from 46 percent of the market in 2008 to 2 percent in 2012.

Regardless of BlackBerry 10's advances, though, the new system will face a key shortcoming: It won't have as many apps written by outside companies and individuals as the iPhone and Android. RIM has said it plans to launch BlackBerry 10 with more than 70,000 apps, including those developed for RIM's PlayBook tablet, first released in 2011. Even so, that's just a tenth of what the iPhone and Android offer. Popular services such as Instagram and Netflix won't have apps on BlackBerry 10.

GOP looks to fight Dems, not negotiate with Obama

WASHINGTON (AP) ? Is Washington's backroom dealing dead?

House Speaker John Boehner says he no longer wants to negotiate deficit reduction with President Barack Obama. The president says he won't negotiate raising the government's borrowing authority. Rank and file lawmakers say they're tired of being left out of the loop and insist on the regular legislative process.

If those are New Year's resolutions, they can certainly be broken. But at the start of a second presidential term, cutting a secret, late night fiscal bargain with the White House on the phone and with a handshake suddenly seems so yesterday.

"No more brinkmanship," Senate Republican leader Mitch McConnell declared. "No more last-minute deals."

What's in, for the moment at least, is a more deliberative legislative process. House Budget Committee Chairman Paul Ryan, last year's Republican vice presidential nominee, says it's all about "prudence."

For the nation, that could mean less manufactured drama like the New Year's deal that averted the once-dreaded "fiscal cliff." For the stock market, it might mean less political volatility. And for the economy, it could provide a dash of needed stability.

The reasons for this turn are fundamentally political.

Republicans are less interested in battling a re-elected Obama, with his higher popularity ratings, than they are in confronting Senate Democrats. Last week's tactical retreat by House Republicans from a clash over the nation's borrowing authority is forcing the Senate's Democratic majority to assemble a budget, making Democratic senators accountable for a series of specific policies and clarifying differences between the parties ahead of the 2014 midterm elections.

Unlike the emerging bipartisanship on an overhaul of immigration laws, conflicts over budgets and deficits frequently have been resolved in a crisis atmosphere. And while immigration changes have been pushed by a changing political landscape, issues of spending and taxing define the core of both parties.

Republicans and the White House have tried twice in two years to reach a "grand bargain" to reduce the long-term deficit only to settle for a smaller incremental deal. The process has tested the relationship between Obama and Boehner and created tensions for Boehner with his own Republican lawmakers. In the process, lawmakers had to vote urgently on deals many had barely seen.

"Cooling your heels for 72 hours or 48 hours while there's some backroom deal going on that cannot be discussed is not exactly why people ran for the Senate," said Sen. Bob Corker, R-Tenn., who had unveiled his own 10-year, $4.5 trillion solution for averting the end-of-year fiscal cliff.

What's more, Republican officials have complained that Obama lectured congressional leaders during their meetings, trying to persuade rather than negotiate. White House officials, for their part, complain that Boehner was an uncertain negotiator, never able to guarantee that his party would stand by an agreement.

As Boehner himself confessed last week in a speech to the Republican Ripon Society: "The last two years have been pretty rough." He said newer Republicans lawmakers have come to think of him as "some kind of a squish, ready to sell them out in a heartbeat."

"It really has in fact caused somewhat of breach that I've been in the middle of trying to repair," Boehner said.

While the fight over the government's borrowing limit is now likely to be put off until May, Obama and the Congress still face two upcoming fiscal deadlines that could test this unwillingness for 11th-hour White House negotiations. Tough new spending cuts -- about $85 billion from this year's budget -- are scheduled to kick in on March 1. On March 27, the government faces a potential shutdown if Congress doesn't extend a temporary budget measure.

But at the White House and in Congress, both are seen as far less cataclysmic than failure to raise the nation's debt ceiling. And Republican lawmakers who once shuddered at the idea of massive cuts, especially to defense programs, now see the automatic reductions on March 1 as the only recourse to reduce spending.

"It's the bird in hand when it comes to cuts," said Sen. John Cornyn, the second ranking Republican leader in the Senate.

More unclear is how Republicans intend to deal with the debt ceiling in May, when Congress again will have to act to raise it or extend it.

The White House is no more enthusiastic for last-minute deal making than Republicans are. Fiscal negotiations have been time consuming events that have left Obama with little time to pursue other aspects of his agenda.

If freed from such talks, he can now push his proposals for overhauling immigration laws and combating gun violence.

"Going regular order slows things down and takes the president out of a central role but it's still an influential one if he wants it," said Patrick Griffin, White House legislative director under President Bill Clinton. "The more it looks like he's winning, the better the next battle goes for him."

What's more, White House officials say, Obama's negotiating stance is now well known after he made a public offer to Boehner in December that Boehner turned down. That offer, White House officials say, still stands: Lower cost-of-living adjustments for Social Security recipients and other beneficiaries of government programs, $400 billion in reduced spending in Medicare and other health care programs over 10 years, and $600-$700 billion in tax revenue from closing loopholes and deductions by rewriting the tax code.

In a memorandum to her colleagues, the new Senate Budget Committee chair, Sen. Patty Murray, D-Wash., emphasized that "we could raise hundreds of billions of dollars by making sure the rich no longer benefit disproportionately from deductions and other tax preferences." The letter did not specify an amount of revenue. Republicans say any new tax revenue is out of the question.

In 2014, there are 35 Senate seats up for election, 21 held by Democrats. Republicans see that as an opportunity to pick up some seats and they see a clash over taxes as a winning proposition, especially in states Obama lost.

Moreover, a Democratic budget will test whether Democrats will embrace the Medicare cuts and Social Security changes that Obama proposed privately in previous unsuccessful talks with Republicans.

"The president hasn't offered any of those kinds of plans in public," Ryan said Sunday on Meet the Press. "They try to do back room deals, but those always seem to fall apart. We want to have a debate in public so we can contrast these visions."

The ad by the fast-food chain was touting its variety 12-pack of?tacos, with a voiceover saying that bringing a vegetable tray to a party is "like punting on fourth and one." It said that people secretly hate guests who bring vegetables to parties.

The Center for Science in the Public Interest, a health advocacy group, this weekend urged people to tweet their complaints about the ad and the chain quickly made the decision to pull it.

"We didn't want anyone to misinterpret the intent of the ad," says Rob Poetsch, a?Taco?Bell?spokesman.

The Center for Science in the Public Interest thanked?Taco?Bell?for its speedy response.

Smaller Snacking is Smart Snacking: New study shows 'just a bite' will satisfy

Jan. 29, 2013 ? How much chocolate would you need to eat to be satisfied? Less than half as much as you think, according to this recently published Cornell University snacking study. Using chocolate chips, apple pie, and potato chips, researchers Ellen van Kleef, Mitsuru Shimizu, and Brian Wansink designed a study to determine if people who were given smaller portions of snack foods would feel hungrier or satisfied fifteen minutes after eating.

Two groups with different portion sizes were tested. The larger portion size group was given 100g of chocolate, 200g of apple pie, and 80g of potato chips, all slightly larger than the recommended portion sizes. This equaled 1370 calories in snack foods. The other group was given 10g, 40g, and 10g of these same foods respectively, for a total of 195 calories. The two groups were given as much time to eat as needed, and were asked to fill out surveys to rate the liking, familiarity, and boredom with the food. They were also asked to rate their hunger and craving before the food was presented and fifteen minutes after the taste tests ended.

The results remarkably showed that smaller portion sizes are capable of providing similar feelings of satisfaction as larger ones. Those given larger portions consumed 77% more food, amounting to 103 calories more, but they did not feel any appetite enhancing or stronger feelings of satiety than the group with the smaller portions. Overall these findings reflect the importance of portion size. While larger portions result in increased food intake, smaller portions may make you feel equally satisfied. The smaller portions can lead to a decline in hunger and desire that would help people limit their food intake. So, next time you are craving a snack food, remember that you can feel similarly satisfied with one handful as you would with two!

BRISBANE, Australia (AP) ? Thousands of Australians huddled in shelters Tuesday as torrential rains flooded cities and towns in the northeast, killing four people and prompting around 1,000 helicopter evacuations.

With floodwaters expected to peak in most of the worst-hit areas later Tuesday, officials were rushing to move those in the highest-risk areas to safety.

In the hard-hit city of Bundaberg, 385 kilometers (240 miles) north of Brisbane, rescue crews plucked 1,000 people to safety after the river that runs through town broke its banks, sending fast-moving, muddy water pouring into streets and homes. Around 1,500 residents fled to evacuation centers, while patients at the local hospital were being airlifted to Brisbane as a precaution.

"Listen to the roar of the water ? that's not helicopters," Queensland Premier Campbell Newman said. "You see a lot of locations where there are literally sort of rapids. There's white water out there, so it is very dangerous."

Between 2,500 and 3,000 homes and 200 to 300 businesses were inundated with water, Bundaberg Mayor Mal Forman said.

Queensland residents and officials were being particularly cautious, after floodwaters from heavy rain in late 2010 and early 2011 left much of the state under water in the worst flooding Australia had seen in decades. The 2010-2011 floods killed 35 people, damaged or destroyed 30,000 homes and businesses and left Brisbane, Australia's third-largest city, under water for days.

The current flood crisis was not as severe, though some areas in northern New South Wales were hit by more than half a meter (about 20 inches) of rain, State Emergency Services Deputy Commissioner Steve Pearce said. Four people have died, including a 3-year-old boy who was hit by a falling tree in Brisbane.

"We're expecting flash flooding, we're expecting trees to be brought down, wires to be brought down by these winds," Pearce said. "We're expecting a very challenging 24 hours in front of us."

In the New South Wales city of Grafton, 600 kilometers (370 miles) north of Sydney, the river peaked just below the top of the levee wall, prompting relief among officials who had ordered an evacuation affecting 2,500 residents.

"It does appear as though the worst of it is over," New South Wales Premier Barry O'Farrell said.

The flooding was caused by the remnants of a tropical cyclone that sparked tornadoes and created sea foam that came ashore on the Queensland coast. The foam covered roads in places, causing traffic to be diverted. Elsewhere, beach-goers waded into the bubbles to pose for photographs.

Australia has been suffering through a summer of weather extremes, with blistering temperatures and dry conditions igniting hundreds of wildfires across the southern half of the country.

We thought App.net had eyes only for Twitter when the project was funded and garnered its first 20,000 customers. Today, a post on the company blog reveals that its sights are set much higher than mere messaging. Rather than provide just an ad-free alternative to Twitter, it turns out App.net plans to become a social app platform through its new File API and cloud storage services. The API gives devs the tools needed to build any and all social applications they can dream up -- from photo sharing apps to collaboration tools.

Additionally, App.net is giving annual and dev accounts a 10GB cloud locker. That storage can, in turn, be leveraged for simple file sharing by users and as a repository for social data that can be accessed by apps built with the API. So, photos, messages and other info from an App.net account can be fully controlled by users and can be accessed by any social app they choose. This is a stark contrast to Facebook or Google+, where access to such data is controlled by those companies. Of course, the new platform's only as good as its apps, so interested devs should head on down to the source, grab the API, and get started building the next-gen social network.

U.S. lawmaker targets violent video games - Video Games ... - Digit

In the wake of a horrific national tragedy in the U.S., where 20 schoolchildren were shot and killed in an elementary school mass shooting in Sandy Hook, Connecticut, the role of ?violent? video games is under immense scrutiny and part of a national debate spurred from this incident.

In this context, Diane Franklin, a Republican member of the House of Representatives, Missouri, has proposed a sales tax on violent video games.

According to an Associated Press report published on the NBC News website, Missouri?s Rep. Diane Franklin proposed the 1% sales tax to be charged only on video games rated Teen, Mature, and Adult by the ESRB (Entertainment Software Rating Board).

Franklin wants the sales tax levied on violent video games to finance mental health programs and direct law enforcement efforts to curb mass shootings in the future.

Similar attempts to target violent video games failed in the American states of Oklahoma in 2012 and New Mexico in 2008, reports NBC News, while a California law preventing the sale of violent video games to minors was dismissed by the U.S. Supreme Court in 2011.

"Taxing First Amendment protected speech based on its content is not only wrong, but will end up costing Missouri taxpayers," the Entertainment Software Association said in a written statement opposing Franklin?s proposal.

There?s also ambiguity surrounding the proposal?s stand on ESRB ratings, which means Teen-rated popular video games like Guitar Hero, Batman: Arkham City, Need For Speed: Most Wanted, etc., with little or no violence will also be taxed.

Global trend: No link between video games and gun murders
Amidst this raging debate on the role of violent video games as a trigger point for gun-related violence in the U.S., Max Fisher of The Washington Post is quick to point out the lack of connection between the two.

In the graph above, Fisher points to the apparent lack of connection between video games and gun-related murders by extrapolating data from the United Nations Office on Drugs and Crime (and other sources).

The graph suggests that despite more per capita spending on video games in countries like Germany, Australia, France, UK, Canada, South Korea, and Netherlands, gun-related murders in these nations account to less than a fraction of what transpires in the United States.

Of course, the graph fails to differentiate between the types of video games consumed by different nations; also the concentration of violent video games in the analysis is lacking. But one would argue that games like Call of Duty: Black Ops II -- the poster boy of violent video games, with a record-breaking US $500 million sales figure on opening day -- would have fans all over the globe (not just in the U.S.) and would also make up a sizable chunk of this particular statistic.

As Fisher states in his article, ?The search for meaning is a natural response to any tragedy,? and while the role of violent video games is under investigation and debate as a potential trigger towards gun-related shootings, it is perhaps premature to jump to any logical conclusion in terms of drafting legislation against video games, given the lack of precise data required to ascertain the situation.

Apple Inc. and Amazon.com Inc. were ordered by a judge to hold settlement talks in their lawsuit over the use of the term "app store."

According to Bloomberg, the talks will be held March 21 and the companies were told to " bring their lead attorneys and people who have full authority to negotiate and settle the case" by the judge.

The court date for the suit is in August, according to the report, and a portion of Apple's argument in the case was thrown out on Jan. 2.

Sales tax instead of income tax? States mull major moves

CHAPEL HILL, North Carolina (Reuters) - Hopes for overhauling the federal tax system are fading in Washington, but in some state capitals, tax reform experiments - some far-reaching - are fast taking shape.

Across the South and Midwest, Republicans have consolidated control of state legislatures and governorships, giving them the power to test long-debated tax ideas.

Louisiana Republican Governor Bobby Jindal, for instance, called on Thursday for ending the state's income tax and corporate taxes, with sales taxes compensating for lost revenue.

A similar plan is being pushed by Republicans in North Carolina. Kansas, which cut its income tax significantly last year, may trim further. Oklahoma, which tried to cut income taxes last year, is expected to try again.

"When it comes to getting pro-growth tax reform done this year, the only real opportunities are at the state level," said Patrick Gleason, director of state affairs for Americans for Tax Reform, the Washington-based anti-tax lobbying group headed by small-government conservative activist Grover Norquist.

His group and other conservative pressure organizations, such as Americans for Prosperity, have targeted state capitals for tax reform campaigns.

Cutting income taxes and shifting the overall tax burden to consumption through higher sales taxes is a long-standing goal of some tax theorists. Critics argue that approach is regressive and unfairly burdens the middle class and the poor, who spend more of their earnings on items subject to sales tax.

Nicholas Johnson, a state tax expert with the left-leaning Center on Budget and Policy Priorities, gave the chances of sweeping tax changes taking hold a low probability.

Still, he said he worried the efforts in the states could move the tax discussion in a direction harmful to middle- and low-income taxpayers and make balancing state budgets harder.

"Even if this is too radical, if it makes other radical schemes seem more reasonable, that's worrisome," he said.

SINGLE-PARTY CONTROL

But the political moment may have arrived for a test.

Thirty-seven of the 50 states now have single-party control of legislatures and governorships: 25 Republican, 12 Democratic. In those states, unlike Capitol Hill, partisan gridlock is not a big issue, making difficult projects such as tax reform easier.

In addition, new ideas look attractive in states that have suffered for years from high unemployment and tight revenue

"We have no choice but to make change," said Bob Rucho, a Republican state senator in solidly Republican North Carolina, who is leading a push in that state for major tax changes.

Rucho and other like-minded lawmakers have a plan to do away with all state individual and corporate income taxes. The plan would replace lost revenue with a new business license fee and a higher sales tax on goods and services not now taxed by the state, such as legal, accounting and spa services, and food.

In his inaugural address on Saturday, Republican North Carolina Governor Pat McCrory promised to work with business "as partners" to eliminate taxes and regulation that stifle growth.

Rucho's plan would remake the North Carolina budget, which now derives 65 percent of its $18.5 billion in total tax revenues from individual income and corporate taxes.

To make up for that much lost revenue, the state sales tax rate would have to rise to 6.53 percent from 4.75 percent, according to a supportive study done by a consulting firm run by Arthur Laffer, a former adviser to Republican President Ronald Reagan and one of the fathers of "trickle-down" economics.

SPURRING GROWTH?

U.S. states often test reforms too controversial for Washington to tackle. Although several states, including Texas and Florida, have no individual income tax, Alaska stands out in modern times for having repealed its personal income tax. It was able to replace the lost revenue with its huge state oil income.

The kind of basic shift to sales tax from income tax being eyed by Republicans is informed partly by "trickle-down" or supply-side economics - embraced by Republicans 30 years ago and still a powerful force in the party. Laffer has advised some of the states' activists.

North Carolina's Rucho acknowledged the argument that the poor would be hit disproportionately by higher sales taxes. But he said new sales taxes on services would also hit higher-income taxpayers.

He said low-income people got more government assistance that could help offset higher tax costs. Also, he added, cutting income taxes would spur economic growth, a key supply-side tenet, helping everyone.

In an interview with Reuters, Laffer said states with lower income tax burdens outperformed those with higher taxes.

Some studies, from liberal and non-partisan think tanks, say just the opposite and cite the relative economic strength of high-tax states such as New York.

(AP) ? A judge has ordered the Colorado theater shooting suspect to stand trial, but his attorneys say they're not ready to enter a plea.

District Judge William Sylvester ruled Thursday night that prosecutors had presented sufficient evidence to proceed with charges alleging James Holmes killed 12 people and injured 70 others at a suburban Denver movie theater July 20.

Holmes is charged with multiple counts of first-degree murder and attempted murder.

The next major step is for Holmes to enter a plea during an arraignment hearing. Sylvester scheduled the arraignment for Friday but noted that defense lawyers will likely ask for a delay.

His defense attorneys filed papers earlier Thursday saying he's not ready to enter a plea.

Holmes' attorneys also objected to news media requests to bring cameras into the courtroom during the arraignment. Cameras have been barred from court since Holmes' initial appearance in July.

If Holmes, 25, is convicted of first-degree murder, he could face the death penalty. Prosecutors have not said whether they would pursue that sentence.

At a preliminary hearing this week, prosecution witnesses testified that Holmes spent weeks amassing an arsenal and planning the attack at a midnight showing of "The Dark Knight Rises." They also detailed an elaborate setup at Holmes' apartment designed to explode at the same time as the theater attack several miles away.

Prosecution witnesses testified that Holmes began acquiring weapons in early May and by July 6 had two semi-automatic pistols, a shotgun, a semi-automatic rifle, 6,200 rounds of ammunition and high-capacity magazines that allow a shooter to fire more rounds without stopping to reload.

Holmes' lawyers called no witnesses this week. They have said he is mentally ill.

The defense motion suggested the possibility of more delays in the case.

One possible reason that Holmes' attorneys could ask for a delay is to seek a mental health evaluation by a doctor of their choosing. If Holmes enters an insanity plea, an evaluation would be done by doctors at the state mental hospital.

Either side also could argue that Holmes is not mentally capable of assisting in his own defense. If that happens, the judge would order a mental competency evaluation. Sylvester also can order an evaluation if he has his own questions about Holmes' competence. Doctors at the state mental hospital in Pueblo would conduct such an examination, which can take months.

If Holmes were to be found incompetent, the case would come to a halt while he receives psychiatric treatment at the state mental hospital. He would remain there until doctors can restore him to competency, at which point the case would continue.

Once the judge rules Holmes is competent ? either immediately after a competency hearing or after psychiatric treatment ? and any other delays are resolved, Holmes would then enter a plea.

This happened with Jared Loughner in the Tucson, Ariz., shooting that killed six people and wounded 13, including then-Rep. Gabrielle Giffords. A federal judge ruled Loughner was incompetent to stand trial. After more than a year in treatment, Loughner was ruled competent, the case proceeded, and he entered guilty pleas. He is serving life in prison.

Ultimately, Holmes was widely expected to plead either not guilty or ? more likely ? not guilty by reason of insanity. In the latter case, too, Sylvester would order a psychiatric evaluation by doctors at the state hospital in Pueblo. A jury would consider that evaluation, along with testimony by expert witnesses, any other court-ordered evaluations and other evidence, in deciding at a trial whether Holmes is or is not guilty by reason of insanity.

If found not guilty by reason of insanity, Holmes would be committed to the state mental hospital for treatment. His case would be reviewed every six months. He conceivably could be released if he ever is deemed no longer insane.

"Insanity is what this case is going to turn on," said Denver criminal defense attorney Dan Recht. "This is not a whodunit case."

Consumer watchdog tightens mortgage lending rules on banks

WASHINGTON (Reuters) - More than five years after the housing market collapsed, the U.S. government's newly created consumer watchdog said Thursday it will force banks to verify a borrower's ability to repay loans to ward off the kind of loose lending that helped push the U.S. economy into recession.

The Consumer Financial Protection Bureau said its new guidelines would also protect borrowers from irresponsible mortgage lending by providing some legal shields for lenders who issue safer, lower-priced loan products.

Lenders and consumer groups have anxiously awaited the new rules, which are among the most controversial the government watchdog is required to issue by the 2010 Dodd-Frank financial reform law.

"When consumers sit down at the closing table, they shouldn't be set up to fail with mortgages they can't afford," Richard Cordray, the bureau's director, said in a statement.

The new rules are intended to combat lending abuses that contributed to the U.S. housing bubble, when shoddy mortgage standards led American households to take on billions of dollars in debt they could not afford.

The U.S. economy is still feeling the after-effects of the bubble, which sparked a global credit crisis after it burst in 2006. As the housing market imploded, banks sharply tightened the screws on lending.

Regulators said the new rules would head off future crises by preventing irresponsible lending, without forcing banks to restrict credit further. Lenders will have to verify a potential borrower's income, the amount of debt they have and their job status before issuing a mortgage.

And because lenders are likely to want the heightened legal protection that comes with offering certain "plain vanilla" loans, the rules could go a long way in determining who gets a loan and who can access low-cost borrowing rates.

SAFE HARBOR FOR LENDERS

Dodd-Frank directed regulators to designate a category of "qualified mortgages" that would automatically be considered compliant with the ability-to-repay requirement. The rule was first set in motion by the Federal Reserve and then handed off to the consumer bureau in July 2011.

The consumer protection bureau said on Thursday that it would define "qualified mortgages" as those that have no risky loan features - such as interest-only payments or balloon payments - and with fees that add up to no more than 3 percent of the loan amount.

In addition, these loans must go to borrowers whose debt does not exceed 43 percent of their income.

These loans would carry extra legal protection for lenders under a two-tiered system that appears to create a compromise between the housing industry and consumer advocates.

Bank groups had lobbied the bureau to extend a full "safe harbor" to all qualified loans, preventing consumers from claiming in lawsuits that they did not have the ability to repay them. But consumer advocates wanted a lower form of protection that would allow borrowers greater latitude to sue.

Under the rules announced on Thursday, the highest level of protection would go to lower-priced qualified mortgages. Such prime loans generally will go to less-risky consumers with sound credit histories, the bureau said.

Higher priced loans would receive less protection. Lenders would be presumed to have verified the ability to repay the loan, but borrowers could sue if they could show that they did not have sufficient income to pay the mortgage and cover other living expenses.

CREDIT AVAILABILITY

Some lawmakers and mortgage lenders had warned against a draconian rule that could exacerbate the current credit crunch and set back a housing market that has become a bright spot in an otherwise tepid economic recovery.

Consumer bureau officials said they were sensitive to concerns about credit tightening, and they baked into the rules several provisions meant to keep credit flowing and to smooth the transition to the new regime.

The new rules establish an additional category of loans that would be temporarily treated as qualified. These mortgages could exceed the 43 percent debt-to-income ratio as long as they met the underwriting standards required by Fannie Mae, Freddie Mac or other U.S. government housing agencies.

The provision would phase out in seven years, or sooner if housing agencies issue their own qualified mortgage rules or if the government ends its support of Fannie Mae and Freddie Mac, the two housing finance giants it rescued in 2008.

Regulators also proposed creating a qualified mortgage category that would apply to community banks and credit unions.

Banks will have until January 2014 to comply with the new rules, the consumer bureau said.
